Amendment II

A well regulated Militia, being necessary to the security of a free State,
the right of the people to keep and bear Arms, shall not be infringed.

 

If you read Amendment II and agree that every adult can own firearms WITOUT any restriction, there is NO need to read the rest of this page. You and I agree completely. We have a Natural Right.

If you disagree, shall not be infringed is still the law of the land. To change a Natural Right a constitutional amendment is necessary. Until then, proposed laws counter to Amendment II are unconstitutional.

Tools and Work

A hammer in a toolbox or on a shelf does nothing. A firearm similarly simply rests where it was placed. Both are inanimate objects. It takes a human, with intent, to use a tool. That use can benefit others or harm others. The human user is responsible. Every. Single. Time.

Mass Shootings

In every tragedy a human being willfully pulled the trigger. Every. Single. Time.

Our first step as society it to demand that local authorities perform the proper investigation to establish the facts. Then pursue justice thru the court system. These judicial processes must be conducted without the court of public opinion influencing the legal proceedings. In many cases a gag order on "the news" will better ensure that justice is served.

Anti-social reprobates (who pulled the trigger) must be held accountable. Society demands justice.

Red Flag Laws?

NO. This type of law is unconstitutional per Caliglia v Strom (a 9-0 decision!). There will be Due Process!  This "solution" is NOT available.

Ethan's Law – HR 748

The story of Ethan is certainly tragic. But the core of the case is an irresponsible gun owner made a mistake. The gun owner bears ample negligence. This gun owner is a very small minority of gun owners who do NOT properly respect firearms. Conversely, a high preponderance of gun owners (yes, including NRA members) have respect for firearms and are responsible gun owners.

The flaws in HR 748 are:

In this case, the gun owner was obviously careless and lacked common reason. Yet, his lack of storage is NOT a crime. The gun owner is more culpable for NOT instructing his child on proper gun safety. I would have expected a legal proceeding against the gun owner with the verdict rendered against the gun owner.

¿Assault Weapons?

Responsible gun owners do NOT recognize this term; it is made up. Whatever the intent of the "definition"; shall not be infringed still applies.

Urban Crime

What is being done to identify and prosecute aggravated assaults in our larger cities?  Just asking …
